Treaty Implications of Dissolved Gas Management in the Columbia River Basin
“This paper analyses the implications of the 1964 Columbia River Treaty between the United States and Canada (the “CRT”) and other treaties and agreements on the management of dissolved gas in the Columbia River Basin (the “Basin”). The conclusion reached is that while the CRT prohibits the implementation of gas abatement measures at the expense of power and flood control capabilities, gas abatement can be achieved in ways that do not diminish these capabilities and therefore do not violate the CRT. The 1909 Boundary Waters Treaty (the “BWT”), the 1985 (amended in 1999) Pacific Salmon Treaty (the “PST”), First Nations treaties, the British Columbia/Washington Environmental Cooperation Agreement, and the national laws of the United States and Canada all support the implementation of gas abatement.” Abstract taken from report.
